General (r) Pervez Musharraf’s lawyer Salman Safdar said on Tuesday (Dec 17) while addressing a press conference said that the decision against former President Pervez Musharraf in high treason case was announced in haste adding that Musharraf was not given fair trial.
“This [ruling] is worse than the decision to hang Zulfikar Ali Bhutto,” said Safdar during a press conference. “There are various mistakes in the procedure.” “Our arguments were not heard,” the lawyers complained, declaring that constitutional requirements were not fulfilled in this case.
“This was the first instance that a high treason case was going to court and yet this was not a fair trial,” Musharraf’s lawyers told the media. “Article 342 was very important but our arguments were not heard,” the legal team said, adding that the decision was announced in haste. They also said that every accused has the right to present witnesses, “Yet none of our eight witnesses we’re allowed to testify.”
“Pervez Musharraf is currently under medical treatment, talking on Skype would not have been possible,” the lawyers asserted in reference to the special Court allowing the former military ruler to testify via video link. “He will surrender when his health will allow it,” they said.
“Instead of the cabinet, only the prime minister gave the approval for the case against Musharraf,” he said. “Why weren’t Shaukat Aziz and Justice (r) Abdul Hameed Dogar included as suspects in the case?” “We were shocked by the decision that was announced by the special court today,” she said.
A three-member bench of the special court on Tuesday (Dec 17) has announced death sentence to former President Pervez Musharraf in high Treason case with 2-1 split . The bench comprising Peshawar High Court Chief Justice Waqar Ahmad Seth, Justice Nazar Akbar of the Sindh High Court (SHC) and Justice Shahid Karim of the LHC resumed the hearing of the high treason case.
