A three-judge bench of Supreme Court, headed by Chief Justice of Pakistan (CJP) Mian Saqib Nisar has imposed a ban on the sale of land under use by the Pakistan Railways in the federal and provinces.
“The railways cannot lease land owned by centre and province for more than five years while land not required for railways operation can be leased for five years,” it said. As the hearing of a case related to allegedly illegal occupation of the Pakistan Railways’ land went underway CJP said “Provinces can lease railways’ land but cannot sell it. However, this does not mean that the land be leased out for 99 years.”
At this, the railways minister said Sheikh Rashed, “We are not even selling a single square yard of land. Some land has been leased for three to five years.” “We can earn Rs3 billion in profits annually if we lease the land,” he maintained. “Land which is not required for railways’ operations can be leased for a period of five years,” the bench further stated. “Pakistan Railways does not have the permission to construct any housing society,” it added. Supreme court of Pakistan also barred illegal occupation of railway land.
